The terms on which App-Artery provides Fleet Log to workshops in the United Kingdom.

The agreement

These terms are between App-Artery and the workshop that holds the Fleet Log account. Accepting them binds the workshop, and only a workshop owner can accept them.

Where these terms and our data processing agreement disagree about personal data, the data processing agreement wins.

The service

Fleet Log records customers, vehicles, job cards and service history for a garage, and reports on them. It is provided over the internet; nothing is installed on your machines.

Access is by invitation. A workshop owner invites their staff and sets what each person may do. There is no public sign-up, and we do not create accounts for anyone the workshop has not invited.

Availability

We provide Fleet Log on a best-efforts basis. We do not commit to an availability percentage at this stage, and you should not rely on one.

The service will be unavailable briefly when we deploy new versions, and it may be unavailable for maintenance. We would rather say this plainly than publish a number our infrastructure cannot be held to.

Your data is backed up daily and backups are kept for seven days.

Support

Support is by email and WhatsApp. We aim to respond within one working day. Working days are Monday to Friday, excluding public holidays.

That is a target we take seriously, not a guaranteed response time, and it does not carry a credit or a refund if we miss it.

Your responsibilities

You are responsible for the accuracy of what you record, for having a lawful basis to hold your customers' details, and for telling your customers what you do with them.

You are responsible for keeping sign-in credentials secure and for removing people who leave. Tell us promptly if you think an account has been compromised.

You must not use Fleet Log to store data you have no right to hold, to attempt to reach another workshop's records, or to probe the service's security without our written agreement.

Your data

The records your workshop enters remain yours. We claim no ownership of them and we do not use them for any purpose other than providing the service to you.

You can ask for an export of your data at any time while your account is open, and we will provide it in a machine-readable form.

Fees

Any fees, and the terms on which they are charged, are as agreed in writing with the workshop. Where no fee has been agreed, the service is provided free of charge and either side may stop at any time.

Liability

Neither side excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

Subject to that, our total liability to you in connection with these terms, whether in contract, tort or otherwise, is limited to the total fees you paid us in the twelve months before the claim arose. Where no fees have been paid, that amount is nil.

We are not liable for loss of profit, loss of business, or loss of data to the extent that loss could have been avoided by your keeping your own records. Fleet Log is a record of your work; it is not a substitute for your accounts.

Ending the agreement

You may stop using Fleet Log at any time and ask us to delete your data. We may end this agreement by giving you 30 days' notice, or immediately if you use the service in a way these terms forbid.

When the agreement ends we will give you an export of your data if you ask for one within 30 days, and then delete it, apart from records we are legally required to keep.

Changes to these terms

We may change these terms. When we do, the version and effective date at the top of this page change, and workshop owners are asked to accept the new version when they next sign in.

Continuing to use the service does not by itself accept a new version. We ask, and we record the answer.

Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
